Consumer Rental Terms and Conditions
As at September 2025
CONSUMER CONDITIONS
1.1 The Rental Agreement terms and conditions set out below shall apply to and are incorporated into any contract for the
rental of pottery Equipment between POTTER&DABBLE LIMITED (the “Owner”) and the consumer renting the Equipment
(the “Renter”). Equipment includes, but is not limited to, the Nidec Shimpo Whisper-T Pottery Wheel, the Nidec Shimpo RK55, Nidec Aspire Wheel RK-5TF, Nidec Shimpo adjustable potters’ stool, Lee Bat system, giffen grip together, Fin pottery
tools & Frema Slab Builder (the “Contract”).
1.2 For the purposes of this Contract, a “Consumer Renter” refers to a natural person renting the Equipment for personal
use and who qualifies as a “consumer” under the Consumer Guarantees Act 1993 and/or the Fair Trading Act 1986. This
excludes businesses, teaching facilities, group classes, rest homes, or any entity renting the Equipment for commercial
purposes, which will be subject to separate terms. 1.3 Nothing in this Contract affects, or attempts to exclude in any way,
the Renter’s rights under the Consumer Guarantees Act 1993.
2. AMENDMENTS
2.1 The Owner may amend any terms of the Consumer Conditions at any time, at its sole discretion, by posting updated
rental agreement terms and conditions on its website, potteranddabble.co.nz. Any amendments to these terms shall not
apply to any contract entered into prior to the update. 2.2 Notwithstanding clause 2.1, the Renter will continue to be subject
to the Consumer Conditions attached to, and in effect at the time the Renter entered, the Rental Agreement of the
Equipment owned by the Owner. Any amended Consumer Conditions shall apply to a new contract or an existing contract
only at the point of extension, for the rental of the Equipment between the Owner and the Renter.
3. RENTAL CHARGES
3.1 The Equipment is available for rent for a minimum of one week (7 days) worked out as 7 x 24hrs. Rental length beyond 7
days can be booked in weekly increments.
3.2 The rental period begins when the Equipment leaves the Owner’s premises and continues until one of the following
occurs: (a) the Equipment is returned to the Owner at the place of rental in accordance with the booked return date and
time, (b) the Equipment is collected by the Owner as part of the delivery/pickup rental option, or (c) the Contract is
terminated. The rental period concludes when the Equipment is physically returned to the Owner or the Contract is formally
terminated, whichever happens first. Further details on these conditions are outlined throughout the Consumer Rental
Agreement Terms and Conditions. The scheduled pickup and return times are those selected on the rental booking form. If
the Renter picks up the Equipment later than scheduled, the original pickup and return times on the booking form will still
apply. Minor adjustments to the return time, without incurring an additional week’s rental or late return fees, may be made at
the sole discretion of the Owner
3.3 Pickup and return time slots are from our studio in Dairy Flat are. Opening hours are outlined on the contact us page on
our website potteranddabble.co.nz.
3.4 The Renter shall, upon booking the Equipment, pay the full amount for the rental, based on the agreed rental period as
per 3.1. Pricing includes GST and Stripe transaction fee. All bookings include the wheel and the stool. They cannot be
ordered individually. Equipment is charged at a per-week rate, irrespective of whether the Renter wishes to return the wheel
earlier than 7 days
3.5 All pricing for Consumer rentals are in NZ dollars and includes GST, unless otherwise stated. Corporate rates are
separate to Consumer, they are subject to their own terms and conditions and pricing provided excludes GST.
3.6 Proof of identity - Your driver’s license number (or passport number) is requested at the time of booking. The Owner will
request to view and photograph the license at the time of pickup/delivery. If you have organised for someone else to pick up
the wheel: 1) they will need to show their license at the time of pickup, and 2) please email a copy of your license to
[email protected] prior to the commencement of the rental.
3.7 Proof of address – Your billing address and the address (if different) where the Equipment will be used/stored during the
rental period is requested at the time of booking. The Owner will request to view proof of address via either a bank
statement or utility bill (less than 3 months old) prior to the commencement or at the commencement of the rental. The Owner has the right to refuse the rental with no explanation provided. All funds paid in advance will be refunded.
3.8 Extending the rental period: If the Renter decides to extend the rental, please contact the team at
[email protected] prior to the conclusion of the current rental. It is at the sole discretion of the team at
POTTER&DABBLE LIMITED whether the rental extension is approved. A weekly rate will apply for the number of weeks the
Renter would like to extend the rental. If the rental is unable to be extended, the Renter must return the Equipment as per
the initial agreement. Minimum extension is 1 week.
3.9 Returning by the Due Date: The Renter must return the Equipment by the due date and time specified in the booking
form. A late return fee of NZ$50 per day will apply if the Equipment is not returned within two (2) hours of the due time,
unless an extension has been requested by the Renter and approved by the Owner in writing.
3.9.1 The Owner will make reasonable efforts to contact the Renter prior to the rental due date as a reminder of the return
deadline. However, it remains the Renter’s responsibility to ensure timely return. 3.9.2 If the Equipment is not returned within
three (3) days of the due date and the Renter has not made contact, the Owner reserves the right to take further action,
including but not limited to, charging for the full replacement cost of the Equipment and pursuing legal recovery.
3.10 Prior pottery experience: Our Equipment is only available to individuals with prior pottery experience. Renters must
either be currently enrolled in or have completed a beginner’s pottery course. The Owner reserves the right to request proof
of experience or a demonstration to ensure the proper use of the wheel. The Renter agrees to follow all instructions provided
by the Owner and/or the Equipment manufacturer regarding its proper use and safety.
4. DAMAGE
4.1 Responsibility: The Renter is fully responsible for any loss, theft, or damage (including accidental damage) that occurs
while the Equipment is in their possession. This responsibility begins when the Renter signs the rental form at pickup or
delivery and continues until the pottery wheel and stool are returned/picked up and signed for by a team member at
POTTER&DABBLE LIMITED.
4.2 Notify the Owner: The Renter must immediately notify the Owner (within 2 hours) of any issues with the Equipment,
including mechanical defects, breakdowns, damage, or theft. This notification must be made via email at
[email protected], quoting the booking reference.
4.3 In the unlikely event of damage to the Equipment including splashpan, wheelhead, the motor or electrics, the repair will be costed, and repairs will be charged to the Renter to restore the Equipment to the condition it was in at the time of initial
rental. If loss or extensive damage occurs to the wheel, where the repair cost exceeds the full retail price of the Equipment, a full replacement cost will be charged. This will be invoiced to the Renter via a credit card payment link. With payment
required with 48 hours. Late payment will incur a weekly 10% additional fee on cost of parts. For example: Nidec Shimpo
Whisper-T pottery wheel $2,400, Nidec Shimpo RK-55 $2,075• Wheelhead (300mm diameter) NZ$150 • 2-piece splash pan
(480mm) NZ$150, Pottery Stool $125, Griffin Grip $495, Nidec Aspire Wheel RK-5TF, Frema Slab Roller $1500. This is at the discretion of POTTER&DABBLE LIMITED and our suppliers.
In particular:
4.3.1 If the issue involves clay damage or extensive scratches to the wheelhead, the Renter can continue using the wheel for
the rental period and will follow the cleaning instructions as per Clause 7. Any damage to the wheelhead will be dealt with at
the time of return. Note – often clay/water staining will reduce with additional use of the wheelhead.
4.3.2 If the issue involves a broken, damaged, or stained splashpan, the Renter will be charged for a new splashpan, and any
replacement costs associated with changing over the splashpan
4.3.3 If the issue involves any mechanical failure or damage, the Equipment must be returned immediately.
4.3.4 If the problem is a mechanical fault of the Owner’s Equipment, the Owner will be responsible for the cost of repairs or replacement, and the rental charges will be adjusted to reflect any time lost. If the Renter is unable to use the Equipment
due to mechanical failure, a prorated refund may be issued. If the damage is caused by the Renter, the full rental period
charges will apply, and the Owner will not be obligated to provide a refund.
4.4 Inspection: The wheel will be inspected at the commencement of the rental, with photos and/or video taken. An
inspection will also be conducted upon return of the wheel to avoid any unforeseen issues. This process serves to protect
both the Owner and the Renter.
4.5 Regarding the PERSONAL PROPERTY SECURITIES ACT 1999 (PPSA), the Renter acknowledges that the Equipment is owned by the Owner, POTTER&DABBLE LIMITED.
4.6 By renting the Equipment, you agree to the following:
4.6.1 Clay & Glazes: Only use pottery clay purchased from a reputable New Zealand pottery supplier on the wheel. If hand
painting underglaze, or glaze to the clay while using the wheel, please ensure you cover the wheelhead with a
chamois/cloth and clean up any paintsplats immediately. (Cleaning is outlined in Clause 7). Permanent damage to the
splashpan or wheelhead will be charged at full retail rate. No other substances are to be used on the wheel without
permission from the Owner. If damage occurs to the wheel, Clause 4 applies.
4.6.2 Throwing on wheelhead: You can either throw directly on the wheelhead or use the provided (or your own) bat and
chamois. Please note, that the wheelhead does scratch easily. Please do not use sharp tools directly against the wheelhead.
If you are wanting to use these tools, please use the provided chamois and bat. Excessive damage on the wheelhead from
inappropriate use of tools will result in our damage clause applying. Photos will be taken before and after the rental to
monitor this. Some clays may cause staining on the wheelhead, especially if it is not cleaned after each use. We ask that you
do not leave clay, water, or the bat/chamois on the wheelhead for extended periods (i.e., overnight or for several days), as
this will cause damage. If damage does occur, please do not use chemicals to clean the wheelhead. Follow the cleaning
instructions outlined in Clause 7. At the Owner’s discretion, a cleaning fee may be charged to remove staining from clay or
glaze. In the unlikely event that staining cannot be removed, or if it takes longer than 1.5 hours to repair, the full replacement
cost of the wheelhead will be charged.
4.6.3 The pottery wheel is not a toy. Do not leave children unattended near the wheel. Keep tools and small parts out of
reach of children.
4.6.4 Wheelhead & clay weight: Do not overload the wheelhead with clay or force it to stop. The maximum recommended
clay weight for the Nidec Shimpo Whisper-T is 20kgs and RK-55 is 10kgs. Do not sit on the wheelhead or place anything
onto the wheelhead, except for the provided hardwood bat, chamois, and your clay.
4.6.5 Stop operation of the wheel if you smell or see smoke or hear any unusual noise. Turn off the power, unplug the power
cable, and contact the team at [email protected].
4.6.6 The wheel is for throwing clay only. The Equipment designed for ceramic art creation only. Do not place any items,
other than ceramic materials, onto the wheelhead. Water buckets and tools should be placed on the attached side tables.
Do not insert hands or objects into openings or moving parts. Do not move or hold the wheel while the power is on, and be
cautious of loose-fitting clothes, long hair, long nails, and jewellery.
4.6.7 Power connection – connect the power cable to a 230V single-phase AC power outlet only. Do not use with a
generator or 3-phase power, as this will breach the terms of this agreement. Do not connect multiple cables to the same
outlet, as this may cause a fire by exceeding outlet capacity. Ensure the power switch is off when you plug the power cable
into the AC. Do not plug or unplug from the power outlet with wet hands. A surge protector is included with every rental.
Please use this. NB: The Whisper-t takes 5A. Please consider what else you are loading onto a 10A circuit.
4.6.8 Lifting: Do not lift the wheel by the wheelhead or side tables. The wheel must be lifted by two people underneath the
main body of the wheel. The wheel must be placed flat on a horizontal surface. Improper placement may cause vibration.
4.6.9 Do not remove the bottom cover. There are electrical parts inside that need to be protected from hands, water, and
other materials.
4.6.10 Do not place a TV, radio, or antenna close to the wheel, as this may cause additional noise.
4.6.11 Repairs and/or modifications by the Renter are prohibited. If there are concerns with the wheel, stop using it
immediately, turn it off, and contact the team at [email protected].
5. LIABILITY & RESPONSIBILITIES
5.1 The Owner is not liable for any personal injury, property damage, or other losses incurred by the Renter while using the
Equipment, except where required by New Zealand law. The Renter assumes all risks associated with the use of the
Equipment.
5.2 The Renter agrees to use the Equipment in accordance with the guidelines provided in this agreement. Any misuse,
negligence, or failure to follow the instructions may result in damage charges as outlined in Clause 4.
5.3 The Renter is responsible for ensuring the Equipment is used in a safe environment, free from hazards that could cause
damage to the Equipment or injury to users.
5.4 The Owner is not responsible for any loss of work, creative projects, or materials due to Equipment malfunction or misuse.
6. PAYMENT & DEFAULT INTEREST
6.1 Any queries or disputes regarding invoiced amounts must be raised by the Renter with the Owner within 24 hours from
the invoice date. This will allow for prompt review and resolution. This does not apply to full replacement invoices (as
outlined in Clause 4.4).
6.2 Late payments will incur a default interest charge of 10% per month on the overdue balance until fully paid.
7.0 CLEANING
7.1 The Pottery Wheel must be thoroughly cleaned during and after each use by removing slurry, water, and clay remains.
The splashpan is not designed to hold excessive water, so please empty it regularly while in use to avoid leakage. Any
damage caused by splashpan leakage is the full responsibility of the Renter. Please remove your work from the wheelhead
once complete, wipe it down with a damp sponge, and dry it before continuing. Do not leave clay, slip, chamois or water on
the wheelhead for extended periods, as this will cause damage.
7.2 After each session, wipe down the splashpan with the damp sponge provided and remove it for cleaning. Do not leave
the splashpan outside in the sun as it may warp or discolor the plastic. Wipe down the wheelhead and side table with the
provided sponge and dry. The wheelhead must be left clean and dry. Always turn off the power switch and unplug the power
cable before cleaning. Do not pour water on the wheel or use a hose to clean it. Any damage to the electrics or components
caused by improper cleaning will be charged to the Renter.
7.3 Do not dispose of clay slurry down the sink or drain, as this can clog the pipes. Any damage caused by improper
disposal is the full responsibility of the Renter.
7.4 The pottery wheel must be returned clean and ready for use. If the wheel is excessively dirty or the wheelhead is stained
an additional cleaning fee of NZ$50 per half hour will be charged. This fee is at the Owner’s discretion. The Owner will
inform the Renter of any cleaning fees either: (a) at the time of return; or (b) as soon as reasonably practicable after the
Equipment is returned.
7.5 Please do not use chemicals to clean the wheelhead or splashpan. A damp sponge is all that is required. Any concerns,
please contact the Owner. Water staining often disappears through using the wheel.
7.6 You may see a black liquid appearing on the wheelhead while in use or while cleaning. This is the oxidization from the
aluminium alloy wheelhead. This protects the wheelhead from corrosion. Simply wipe is down with a damp cloth or sponge
8.0 LOCATION AND STORAGE OF THE WHEEL AND STOOL
8.1 Equipment placement: The Equipment must only be used indoors, either in a garage, a home, or under a fully covered,
waterproof balcony that is not exposed to the weather. The wheel must be placed on a flat, hard surface, such as concrete,
wooden floor, internal floor coverings, deck, or a solid table (if using without legs). If you are unsure about the correct
placement of the Equipment, please contact the Owner for guidance.
8.2 The Equipment must be stored indoors, either in a house or fully enclosed, waterproof garage. When storing the wheel,
please unplug it and place the plug on the wheelhead. Additionally, place the pedal and cable on the wheelhead to keep
everything organized. The equipment is not to be stored outside, even if covered by a protective material or undercover.
8.3 The Owner is not responsible for any damage to the Renter’s property caused by the wheel, pottery clay, or water. The
Renter is fully responsible for ensuring appropriate floor coverings are used to protect the floors from any damage during
use.
9 LIFTING THE POTTERY WHEEL
9.1 The Nidec Shimpo Pottery Wheels are a 2 person lift. The Owner will provide one person for lifting. We ask that the
Renter provide the other person – either themselves or someone else. This applies when the Renter is picking up/returning
the Equipment or they are having the Equipment delivered to their property. NB: The RK-55 is a lighter wheel at 23kgs and
can be a 1 person lift at the Renters discretion.
9.2 At time of booking the Renter is asked if they are able to assist the Owner is lifting the equipment. If the Renter cannot
assist, they must notify the Owner in advance. The Owner may be able to provide additional assistance, but the day and
time of pickup may change. The rental booking will be amended accordingly.
9.3 Delivery of the Equipment: If the Owner is delivering the Equipment to the Renters home, the Owner will confirm with
the Renter prior to delivering the Equipment to ensure that the Renter
9.3.1 can help lift the Equipment, or provide another person to help as per clause 9.1
9.3.2 or cannot help in carrying the Equipment. If this is the case, the Owner, subject to the Renter’s approval can arrange a
second person to assist at an additional charge of NZ$25 per hour including delivery time. The day and time may change,
and the rental booking will be amended accordingly. Payment is required prior to delivery
9.3.3 During Delivery - If the Owner arrives at the agreed address and no one is available to assist the Owner in carrying the
Equipment, despite agreeing to clause 9.3.1, then the booking will be rescheduled. Full delivery charge will still apply, and
no refund will be given (as per our cancellation policy). An additional delivery charge will apply again to deliver the wheel at
an agreed time in the future. The Renter will be asked to confirm if they wish clause 9.3.1 or 9.3.2 to apply. All charges will
be paid prior to delivery. The rental period will not be reduced or refunded to accommodate the time between deliveries.
9.3.4 During Pickup: If the Renter cannot assist at pickup time to load the Equipment into the vehicle and no prior
arrangement was made for the Owner to provide an additional resource, then the Equipment will remain at the rental
location, and an additional NZ$50 per day will be charged until assistance is available. If a second pickup is required, the
standard delivery fee will apply again. If additional resource is required as well to lift the Equipment an additional $25 per
hour will be charged. Our full terms and conditions will still apply until such time as the Equipment can safely be picked up
and signed off by the Owner
9.3.5 Carrying of the equipment: The Owner will only assist the Renter in carrying the Equipment a short and easy distance
from the vehicle into the Renter’s property (max 5 metres). The Owner will not help in carrying the wheel up or down stairs,
or into tight/ difficult locations. If this is required, an additional resource will be provided at $25 per hour, including travel
time. This needs to outlined in the notes at time of booking or communicated via email [email protected], and
additional payment made for the resource prior to delivery. The Owner is not responsible for any damage to the wheel or
injury to anyone assisting with lifting.
10.0 DELIVERY AND REMOVAL
10.1 Delivery and removal charges are payable by the Renter and are in addition to the rental charges. A quote for these
chargers will be provided by the Owner prior to the commencement of the rental. Full payment for both the delivery and
pickup to be made into the account of POTTER&DABBLE LTD prior to the rental taking place. Account details will be
provided on the quote.
10.2 Delivery fees are determined from the home of POTTER&DABBLE at 102 Tender Road, Dairy Flat to your nominated
address on the booking form and back again. The same applies for pickup. We charge the IRD recommended charge of $1.16per km.
10.2.1 For corporate rentals we only offer a delivery service (pickup from our home base is not possible).
10.3 If Equipment is to be picked up by the Owner, the Equipment must be fully cleaned and ready for pickup. An inspection
will be done of the wheel prior to removing the wheel from the property. This may include plugging the wheel into an
electrical source to check for any electrical damage. This electrical source must be provided by the Renter. This also applies
if the Renter returns the wheel to place of pickup.
10.5 The Renter grants to the Owner, or will procure that the Owner is granted, an irrevocable right and authority to enter,
and for the Owner to bring a vehicle at any time onto the place where the Equipment is to be used or is located to deliver
and/or remove the rented Equipment either on the expiry of the rental period or on termination of the Contract.
10.6 Any requests for removal of rental Equipment must be arranged with the Owner prior to completion of the rental by
email at [email protected]. The relevant removal cost will be notified to the Renter.
10.7 The Owner must provide the Renter with a return slip (via email) once the Equipment has been returned and checked
over in accordance with our damage clauses.
10.8 Securing the Equipment into the Renters vehicle. If the renter is picking up the Equipment, the renter must provide a
suitable vehicle to transport the wheel and ensure the vehicle has appropriate hooks to attach the tie down straps. Four tie
down straps will be provided with each rental. Please ensure the tie down straps are used correctly to secure the wheel in
your vehicle.
10.9 If the Renter is unable to return the wheel due to injury or change in circumstances, please notify the owner as soon as
possible. No refunds will be given if the wheel is returned early, unless at the discretion of the Owner. If the Equipment rental
needs to be extended, and the owner asks prior to the conclusion of the rental, then standard weekly rental fees will apply. If
the Renter does not notify the Owner prior to the conclusion of the Rental, then clause 3.10 will apply. Collection fees are
charged at $2.50per km (round trip).
11. RIGHT TO TERMINATE
11.1 The Renter may terminate the Contract by notice with immediate effect if the Owner fails to comply with any term of the
Contract, in which case the Renter will be entitled to receive a refund of charges paid to the Owner which may be pro-rated
to reflect the reduced rental period, unless any damage to the Equipment is made, and there fore clause 4 and 5 apply.

11.2 The Owner may terminate the Contract by notice with immediate effect if: (a) the Renter fails to comply with any
material term of the Contract; (b) the Owner believes on reasonable grounds that the Equipment may be at risk for any
reason whatsoever, including the manner of its use by the Renter, or the Renter is unable to, or might be unable to, pay any
charges in connection with the Equipment under these terms and conditions, or there have been (c) steps taken to appoint
a receiver, manager, trustee in administration, liquidator, provisional liquidator, statutory 8 manager, administrator or other
like person over the whole or any part of the Renter’s assets or business.
11.3 Where the Owner terminates the Contract, the Renter indemnifies the Owner against, and shall pay to the Owner upon
demand, any cost (including legal costs), claim, damage, expense, or liability suffered or incurred by the Owner whether
arising directly or indirectly from the Owner acting to recover the Equipment or monies payable by the Renter pursuant to
the Contract.
11.4 Upon termination of this Contract, the Renter shall deliver the Equipment to the Owner within 24 hours and shall pay to
the Owner: (a) all Rental charges and other monies due to the Owner at the date of termination, including any damages.
Pick up / collection fees are also applicable if the Owner is required to pick up the Equipment from the Renter’s property. As
per clause 10.9.
12.0 ASSIGNMENT AND RENTER’S OBLIGATIONS
12.1 The Renter shall not assign any of the Renter’s rights or interests under the Contract to any person, and shall not
assign, sublet, charge or part with possession of the hired Equipment or any part of it. If this occurs, it will be 6 deemed as
theft, and our terms and conditions will take immediate effect. In particular clauses 4, 11.4, 12.
12.2 The Owner may at any time assign its rights or interests, or any part thereof, (whether absolutely, or by way of security)
or transfer its obligations or any part thereof under the Contract, to any person.
12.3 The Renter shall: (a) if the Equipment is intended to be used in a location or manner which is outside its usual or
ordinary use, advise the Owner of the intended location and/or nature of use at the time of renting the Equipment; (b)
comply with any special conditions or exclusions (which may apply to specific Equipment or the nature or location of the
Renters intended use of such Equipment) notified to the Renter prior to the Equipment leaving the Owner’s premises and
detailed in the Contract Details; (c) take proper and reasonable care of rented Equipment (including keeping the pottery
wheel secure when not in use and also cleaning the Equipment) and return it to the Owner at the end of the hire period (to
the place of hire, unless otherwise specified in the Contract Details) in the same order and condition as at the
commencement of the rental).
12.4 The Renter shall be responsible, and indemnify the Owner, for any loss, theft or damage to the rented Equipment that
occurs as a result of the negligent or reckless acts or omissions of the Renter from the time the Renter takes possession of
the Equipment until it is returned to the Owner’s possession including: (i) in the case of damage, the full cost of all repairs to
restore the Equipment to the condition it was in at the time of hire; and (ii) in the case of loss, theft or unrepairable damage
to the Equipment, the market value of the Equipment will be charged
12.5 The Renter agrees not to remove, deface, or obscure any marks of identification or Ownership or registration on hired
Equipment.
13.0 LOCKDOWNS & FORCE MAJEURE
13.1 Lockdowns: In the case of a government enforced lockdown, where either the Owner or the Renter cannot return the
rented Equipment within the lockdown specifications, the Rental period will immediately cease, and the Equipment
returned/ picked up (within 24 Hours) as though the rental period has ended, and the Renter will be reimbursed for any
rental period outstanding. Alternatively, the Renter can request to continue to rent the Equipment for the entire relevant
lockdown period. This can be agreed in writing with the Owner and appropriate charges agreed upon. This is up to the
Owners discretion, and if agreement cannot be reached, then the contract period will cease immediately
13.2 Force Majeure: The Owner shall not be held liable for failure to fulfill any obligation under this agreement due to
circumstances beyond their reasonable control, including but not limited to natural disasters, extreme weather, fire, flood,
war, acts of terrorism, government regulations, or power outages. If a force majeure event prevents the Renter from using
the Equipment, a fair resolution will be considered, such as rescheduling or issuing a prorated refund.
14 NOTICES
14.1 Notices shall be properly served on a person if delivered by hand or left at or posted in any prepaid letter addressed to
that person at the confirmed address of the Renter specified on the Contract Details page. Service by post shall be deemed
to be affected on the second day after the day on which the notice was posted.
15.0 CANCELLATION
We understand that sometimes situations are outside of our control. Please contact us at [email protected] if you wish to reschedule your booking, rather than cancel, and we will do our best to rebook your rental in the next available slot. Cancellation policy will not take effect. If you would like flexibility with your rental, perhaps book for a shorter period of time, and opt to extend the rental. This is subject to availability.
15.1 Bookings cancelled prior to seven days of the commencement of the start date of the booking will be fully refunded.
15.2 Bookings cancelled within seven days prior to the commencement of the date of the booking will be refunded 50% of
the booking.
15.3 Bookings will not be refunded if cancelled on the day that the booking is due to commence.
15.3 If the Renter decides to return the Equipment prior to the end of the rental period, no refund will be given. If the Renter
makes an error when booking the wheel regarding return dates this can be discussed and rectified prior to the rental
commencing or when the wheel is being collected/delivered
16.0 LIMITATION OF LIABILITY, INJURY OR DAMAGE TO THE RENTER, THIRD PERSON OR PROPERTY. INDEMNIFICATION
AND LIMITATION OF DAMAGE
16.1 As a consumer, the Renter is entitled to certain rights and remedies under the Consumer Guarantees Act 1993. For
the avoidance of doubt, nothing in this Contract affects, or attempts to exclude in any way, the Renter’s rights under the
Consumer Guarantees Act 1993.
16.2 The Renter agrees to indemnify and hold Shimpo and/or the Owner harmless from and against all claims and dam
ages, imposed upon of incurred, arising directly or indirectly from the Renters failure to perform or satisfy any of the
terms described in the terms and conditions. In no event shall Shimpo and/or POTTER&DABBLE LIMITED (OWNER) be liable for any injury or damage of any nature involving the Equipment, including incidental or consequential damage to persons or property, any economic loss or loss of use.
17. GENERAL
17.1 Headings are inserted for convenience and shall not affect the construction of the Contract. The singular includes the
plural and vice versa. Words with initial capitals have the meaning ascribed to them in context. Words implying one gender
include the other. A reference to a clause or sub clause is a reference to a clause or sub clause hereof. A reference to
Owner includes its servants, agents, successors, and assigns. The word “including” does not imply limitation.
17.2 If at any time any provision of the Contract is or becomes illegal, invalid or unenforceable in any respect under the law of New Zealand, that will not affect or impair the legality, validity or enforceability of any other provision of this Contract.
17.3 Nothing expressed or implied in this Contract will constitute either party as the partner, agent, employee or officer of, or
joint ventures with, the other party.
17.4 This Contract is governed by the laws of New Zealand. The parties agree to submit to the non-exclusive jurisdiction of the courts of New Zealand.
18. PRIVACY ACT 1993
18.1 The Owner requires personal information and will collect and hold personal information about the Renter, principally
for the purpose of evaluating the rental of the Equipment by the Renter. The Renter’s application to rent Equipment may be declined or the rental terminated if the Renter fails to provide requested personal information. The Renter can access and seek correction of any personal information by contacting the Owner. The Renter agrees that its personal information
may be used by the Owner to advise the Renter of the Owner’s other goods and services.
19. TIERED PRICING STRUCTURE (for the Whisper-Ts & RK-55)
19.1 Weekly rates are charged according to the length of your booking at the time it is made. Full payment for the booked period is required upfront. The current tiers are: 1–3 weeks → $100 per week . 4–7 weeks → $80 per week. 8+ weeks → $70 per week The $70 per week rate only applies once 8 weeks have been booked upfront or once a booking extends into its 8th week.
19.2 Upfront Bookings Your weekly rate is set when you make your booking. For example, if you book 4 weeks upfront, the entire 4 weeks will be charged at $80 per week. If you book 8 or more weeks
upfront, the entire booking will be charged at $70 per week.
19.3 Extensions: Extensions are always subject to availability. Any extension weeks are charged according to the tier that
those additional weeks fall into. Previous weeks are not recalculated if you extend your booking.
Example: Book 4 weeks ($80/wk = $320). Extend for another 4 weeks → wks 5–7 charged at $80, week 8 charged at $70.
19.4 Per-Booking Basis: Pricing applies per booking. Discounts or tiered rates cannot be carried over to a new, separate
booking. If you return a wheel and later book again, that new booking starts fresh at the current tier rates.
19.5 Extensions must be paid in full before the additional rental period begins. Extensions are not guaranteed as they are
based on availability. To secure your wheel at the best rate, we recommend booking for the full period upfront.
19.6 Changes to Pricing: The Owner reserves the right to adjust pricing. Bookings already paid will not be affected.
